Terms of Service

Effective April 28, 2026

1. The service

CrusaderBase("the Service") is a platform of AI agents operated by Not Beer Inc. that automates operational workflows for consumer-packaged-goods brands — including, in v1, an influencer/creator sample program agent that integrates with Instagram. Additional agents may be released over time and will be governed by these Terms.

2. Eligibility

You may use the Service only if you are at least 18 years old and authorized to bind the business on whose behalf you are using it. By creating an account, you represent that you meet these requirements.

3. Your account

You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly at dillon@enjoynotbeer.com if you suspect unauthorized access.

4. Acceptable use

You agree not to:

  • Use the Service to violate any law, regulation, or third-party right.
  • Use the Service to send spam, deceptive content, or messages that violate Meta's Platform Terms or Instagram's Community Guidelines.
  • Reverse-engineer, scrape, or attempt to circumvent rate limits or security controls.
  • Use the Service to ship products to recipients you do not have a legitimate basis to ship to, or in violation of state or federal law (including, where applicable, hemp/cannabis shipping regulations).
  • Resell, sublicense, or expose the Service to third parties without our written consent.

5. Approval and authorized actions

Many actions taken by the agent — including outbound shipments — require explicit human approval before execution. By approving such an action, you authorize CrusaderBase to execute it on your behalf and you accept responsibility for the resulting transaction.

6. Third-party services

The Service interoperates with third parties you authorize, including Meta (Instagram Graph API), 3PL providers (e.g. UNIS, ShipStation), and identity, hosting, and storage providers. Your use of those services is governed by their respective terms. We are not responsible for the acts or omissions of third parties.

7. Fees

Fees and billing terms are set forth in your subscription agreement or order form. During pilot programs, the Service may be provided at no charge subject to a separate pilot agreement.

8. Intellectual property

We retain all rights in the Service and its underlying software. You retain all rights in the data you upload or generate (your "Content"). You grant us a limited license to host, process, and transmit your Content solely to operate the Service for you.

9. Confidentiality

Each party will protect the other's non-public business information with reasonable care and use it only to provide or receive the Service.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that any AI-generated output will be accurate. You are responsible for reviewing and approving agent actions before authorizing them.

11. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our aggregate liability arising from or related to the Service will not exceed the fees you paid us in the twelve months preceding the claim.

12. Indemnification

You will defend, indemnify, and hold harmless Not Beer Inc. from any third-party claim arising out of your Content, your use of the Service, or your violation of these Terms.

13. Termination

Either party may terminate for material breach if the breach is uncured 30 days after notice. We may suspend the Service immediately if your use poses a security or legal risk. Upon termination, your data deletion rights described in our Privacy Policy apply.

14. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state and federal courts located in Travis County, Texas.

15. Changes

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice. Continued use after the effective date of an update constitutes acceptance.
